DEFINITIONS

1.1 In the terms and conditions ('Terms and Conditions') the following definitions apply:

1.1.1 'Company' represents Impulse Fitness Ltd., registered at 1 Alexandra Terrace, Guildford, Surrey GU1 3DA.

1.1.2 'Lead' represents any person that has successfully completed and submitted the online 'Book Free Trial' form (the 'Sign-Up Form') on www.theimpulsefitness.com (the 'Website').

1.1.3 'Client' represents any person that has purchased a product or service from the Company

1.1.4 'Studio' represents any Impulse Fitness studios.

1.1.5 'Terms and Conditions' refers to the terms and conditions outlined on this page.

1.2 The Terms and Conditions are also outlined on the back page of the Sign-Up Form.

1.3 The Company reserves the right to change the Terms and Conditions due to adequate reasons. By accepting the Terms and Conditions, Leads and Clients (collectively the 'Members') agree to review the Terms and Conditions regularly and agree to any potential changes.

1.4 The Terms and Conditions will be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.

1.5 If you access and use the Website, you accept and agree to be bound by and comply with the Terms and Conditions. If you do not accept the Terms and Conditions, please do not use the Website.

 

CONTRACTS

2.1 All services and products purchased from the Company must be preceded by the applicant acknowledging, by way of accepting these terms, that they have no physical limitations preventing him/her from participation.

2.2 Acceptance of a Lead as a Client is in the absolute discretion of the Company.

2.3 The Company reserves the right to expel from the Studio, suspend for a specific period or refuse to renew the contract of any Member whose conduct is or may be injurious to the character of the Studio or which amounts to a breach of the Terms and Conditions. Any Member so expelled will forthwith cease to be a Member of the Studio and will not be entitled to any refund for any period during which his membership is suspended.

2.4 The Client is not permitted to accept any services other than those offered on the Website, unless written permission by the management is given.

2.5 All applicants must be over the age of 16 years.

PACKAGES

3.1 All packages must be used within the specified number of days stated below:

3.1.1 Silver Package to be used within 30 days

3.1.2 Gold Package to be used within 65 days

3.1.3 Platinum package to bu used within 90 days

PAYMENT TERMS

4.1 Any Client is forthwith liable for the full amount due, as reflected on the face of the Sign-Up Form.

4.2 The payment for a single session must be done before or just after the training.

4.3 The contract starts on the day the contract has been signed.

4.4 The Client accordingly agrees that if they fail to make payment by the due date then the full outstanding amount shall accrue interest on the full outstanding amount at the prime rate charged by the Company's banker from time to time.

4.5 Should the Company be obliged to institute legal proceedings against the Client arising from breach of the Terms and Conditions, including but in no way limited to their failure to pay any amount due by the due date, the Client acknowledge that they shall be liable for all tracing fees, collection commission and legal costs as may be allowed by the court.

4.6 All credit and debit cards will be processed in British Pounds at the time of payment. The Company is not responsible for any fees, charges, exchange rates or additional charges levied by individual financial institutions or credit or debit card companies.

REFUND AND CANCELLATION POLICY

5.1 A cancellation must be made at least 12 hours prior to the training session to be eligible for a free cancellation. You also have the option to reschedule your appointment. In that case, a rescheduling fee of 10 GBP applies. Please notify us at least 6 hours prior to the training session to be eligible for a 10 GBP rescheduling fee.

5.2 If you are unable to continue with the EMS training for any reason, you have the option to cancel your contract anytime within 30 days after signing, no questions asked! After the 30 day cancellation period, you will be obligated to pay the full contract amount.

5.3 Please also note that the EMS sportswear and EMS training packages are non-refundable!

 

FITNESS AND HEALTH

6.1 By agreeing to these Terms and Conditions, Members hereby confirm that they have no health problems including but without limitation to the contraindications stated on the Sign-Up Form that may affect their participation in any session at the Studio or at an external location. If there is any doubt, the Member should consult there doctor.

6.2 It is the Member’s sole responsibility to notify the Studio before attending any class of any circumstances affecting their health which may have arisen or worsened since their last session.

6.3 The Company reserves the right to refuse access to any Member if, in its absolute discretion, it considers the health of the individual concerned may be endangered by the use of the Company's equipment.

6.4 Members are required to follow the instructions of the instructor at all times.

 

LIMITATION OF LIABILITY

7.1 The Company cannot be held responsible for any particular class, instructor and/or item of equipment not being available for whatever reason. The Company reserves the right to make alterations to appointments, instructors and/or equipment, as well as to those ancillary facilities (e.g. showers), provided to Members, without notice.

7.2 It is the Member’s responsibility to ensure that they are capable of undergoing a routine of exercises provided by any programme which they follow. Members accept the risk of injury from performing exercises and using specialist equipment and are advised to consult their doctor prior to beginning any session. Advice provided by our instructors at no time constitutes medical advice in substitute for advice provided by a medical professional.

7.3 The Company accepts no liability for loss or damage to property of Members or for injury to Members on the Studio premises or outside the Studio except insofar as such loss, damage or injury is by law incapable of exclusion.

7.4 In consideration of their participation in the activities and programmes of the Company and the use of facilities and equipment owned and/or under the control of the Company the Member hereby waives and releases the Company from any and all responsibility or liability for injuries or damages resulting from their participation in any of the Company’s activities or use of the Company’s equipment or facilities save in respect of death or personal injury caused by the negligent act or omission of the Company.

 

PERSONAL BELONGINGS

8.1 Personal belongings are brought onto the Studio premises at the Member’s own risk and the Company does not accept liability for any loss or damage whatsoever to such items.
